Regulation (EU) 2022/2065 on digital services (the "DSA") applies to intermediary services offered to persons located in the European Union, wherever the provider is established. IDELOVA hosts and disseminates profiles published by its members: we are a hosting service and an online platform within the meaning of Art. 3(g) and (i) DSA. Summit & Co. is a micro-enterprise; it benefits from the relief in Art. 19 DSA for certain obligations, but we have chosen to apply the safeguards described below voluntarily to all our members, in Switzerland and in the EU.
1. Points of contact and representative
- Point of contact for authorities (Art. 11 DSA): legal@idelova.com — in French, German, Italian or English.
- Point of contact for members (Art. 12 DSA): support@idelova.com, or the "Report" function in the Service. You can write in French, German, Italian, English, Spanish or Portuguese; a person answers you.
- Legal representative in the Union (Art. 13 DSA): ⟦Représentant UE — à désigner⟧. The representative is authorised to receive communications from Member State authorities, the Commission and the European Board for Digital Services, and to answer on our behalf.
Other information is in our Imprint.
2. Reporting illegal content (notice and action, Art. 16 DSA)
Anyone, member or not, can notify us of content they consider illegal (for example: harassment, hate speech, impersonation, fraud, sexual content involving a minor, breach of privacy or copyright).
How:
- In the Service: open the profile or conversation concerned, tap "Report", choose a reason (fake profile, inappropriate photos, harassment, hate speech, scam, underage, off-platform violence, other) and describe the facts.
- By e-mail to legal@idelova.com (illegal content) or safety@idelova.com (danger to a person), stating: (a) why you consider the content illegal, (b) its exact location (first name and age of the profile, city, screenshot, link), (c) your name and e-mail address — except for content relating to sexual offences against minors, for which you may remain anonymous — and (d) a statement that you are acting in good faith and that your information is accurate and complete.
What we do: we acknowledge receipt without undue delay, we examine the notice diligently and objectively, and we inform you of our decision and the available remedies. Repeated manifestly unfounded notices may lead to the suspension of the processing of notices from their author (Art. 23 DSA), after a warning.
Indicative handling times: content endangering a person or involving a minor, within 24 hours; harassment, hate, fraud, within 48 hours; other reports, within 7 days.
3. Our decisions and their reasons (Art. 17 DSA)
When we remove content, restrict its visibility, suspend or delete an account, remove a verification badge, or suspend access to a feature or to monetisation, we provide the person concerned (unless the measure follows an authority order that prohibits it, or in cases of large-scale deceptive commercial content) with a statement of reasons containing:
- the measure taken, its duration and territorial scope;
- the facts and circumstances, including whether the decision follows a notice or our own checks;
- whether automated means were used to detect the content (the decision itself is always taken by a person);
- the basis for the decision: the legal provision or the point of the Community Guidelines concerned, with an explanation;
- the remedies: internal complaint, out-of-court dispute settlement, judicial redress.
We do not disclose the identity of the person who reported. Decisions concerning EU members are transmitted, in anonymised form, to the DSA Transparency Database maintained by the European Commission, where that obligation applies to us.
4. Contesting a decision (internal complaint-handling system, Art. 20 DSA)
You can contest free of charge any decision mentioned in section 3 — including the rejection of your own report — within six months of its notification:
- by replying to the e-mail notifying the decision, or
- by writing to safety@idelova.com with the subject "Complaint", stating the decision number and your arguments.
The complaint is reviewed by a qualified person who was not involved in the original decision, without relying solely on automated means. We reply with reasons within 10 business days (extendable once in complex cases, with notice). If the complaint is upheld, the decision is reversed without delay: the content is restored, the account reactivated and, where applicable, the lost Premium period credited. Reversing a ban lifts the re-registration block (section 7).
5. Out-of-court dispute settlement (Art. 21 DSA)
If you reside in the EU and are not satisfied with the outcome of the internal complaint, you may refer the matter to an out-of-court dispute settlement body certified by the Digital Services Coordinator of a Member State, choosing a body competent for your language and the type of dispute. The list of certified bodies is published by the European Commission. We engage in the procedure in good faith; its decision is not binding and does not deprive you of your right to go to court. If the body decides in your favour, we bear its fees and reimburse the reasonable costs you advanced; if it decides in our favour, you reimburse us nothing, unless you acted manifestly in bad faith.
6. Trusted flaggers (Art. 22 DSA)
Notices from trusted flaggers designated by a Digital Services Coordinator are handled with priority, through a dedicated channel (legal@idelova.com, subject "Trusted flagger"). We also cooperate with child protection and anti-fraud organisations, in Switzerland and in the EU.
7. Measures against misuse (Art. 23 DSA)
After a warning, we suspend for a reasonable period accounts that frequently publish manifestly illegal content, as well as the processing of notices and complaints from persons who frequently submit manifestly unfounded ones. The duration takes into account the number, proportion and gravity of the misuse and the intention. Serious offences (section 7 of the Community Guidelines) lead to permanent deletion without prior warning. A person whose account has been permanently deleted cannot create a new account for 5 years: a hash of their e-mail address is kept for that purpose and then deleted — or deleted earlier if the decision is reversed following a complaint (section 4). After an account is deleted, a pseudonymised moderation record (without content) is kept for 5 years to handle repeat offenders and meet our legal obligations (see the Privacy Policy, section 8).
8. Suspicion of criminal offences (Art. 18 DSA)
Where we become aware of information giving rise to a suspicion of a criminal offence endangering a person's life or safety, we promptly inform the competent law enforcement authorities (in Switzerland or in the Member State concerned, or Europol).
9. Orders from authorities (Art. 9 and 10 DSA)
We give effect to orders to act against illegal content or to provide information issued by competent judicial or administrative authorities, where they meet the conditions of the DSA and the law applicable to a company established in Switzerland (in particular Art. 271 of the Swiss Criminal Code and the rules on mutual legal assistance). We inform the authority of the effect given and, unless prohibited, the person concerned, at the latest when the order is executed.
10. Recommender system transparency (Art. 27 DSA)
Profiles shown in discovery are selected and ranked according to the following main parameters, in order of importance:
- your filters: genders you are interested in, age range, maximum distance, relationship intent, and the "dealbreakers" of your questionnaire (exclusion of incompatible profiles);
- the values compatibility score computed from your answers and the other person's (logic described in the Privacy Policy, section 4);
- the profile's recent activity and completeness (approved photos, number of answers);
- the exclusion of profiles already seen, blocked, unmatched or reported.
A Boost (Premium) temporarily increases a profile's visibility to people whose filters allow it; it does not change the compatibility score. You can change the parameters in point 1 at any time in your preferences; we offer no ranking based on advertising profiling, because we show no advertising.
11. Advertising and minors (Art. 26 and 28 DSA)
We show no advertising in the Service, neither our own for third parties nor third parties', and we do no profiling for advertising purposes. The Service is reserved for adults aged 18 and over; age is checked through the date of birth, through moderation of photos and reports and, in case of doubt, by requesting proof. We collect no additional data to estimate age.
12. Transparency
We publish, at least once a year, a report stating the number of authority orders received, notices handled by reason, measures taken on our own initiative, complaints and their outcome, and the median handling time. The average monthly number of active recipients in the Union is communicated to the competent Digital Services Coordinator on request (Art. 24(3) DSA).
13. Digital Services Coordinator
In the absence of an establishment in the Union, the Member State in which our legal representative is established has jurisdiction (Art. 56(6) DSA). Members residing in the EU may lodge a complaint against us with the Digital Services Coordinator of their Member State of residence (Art. 53 DSA).
